1) Acceptance & Eligibility (17+)
By downloading, installing, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
2) The Service
Flixi is your intelligent travel companion that transforms every trip into a personalized adventure. Simply take a photo of your destination, and Flixi can provide travel information, local highlights, and customized itineraries.
We may add, remove, or modify features at any time. We are not obligated to provide any particular feature or maintain backward compatibility.
3) Accounts
You may need to create an account to use certain features. You agree to provide accurate information (such as name/username and email) and keep it updated.
You are responsible for all activity under your account and for safeguarding your account credentials.
4) Your Content (Photos/Text)
You control uploads
You may choose to upload photos and/or text to generate travel-related results. Uploading is optional and you control whether and when you submit content.
No biometric identification
Flixi does not perform facial recognition, biometric identification, or create biometric profiles.
Limited license to operate the Service
You grant Flixi a limited, non-exclusive, worldwide license to host, process, reproduce, and display your submitted content solely to operate the Service, generate the results you request, provide customer support, and enforce these Terms. This license ends when your content is deleted from our systems (subject to limited backup retention described in our Privacy Policy).
Your responsibilities
- You have the rights to submit your content.
- Your content and use of the Service do not violate laws or others’ rights.
- Your content does not contain malware or harmful code.
5) AI-Generated Outputs
The Service may generate travel suggestions, itineraries, and other content based on your inputs. Outputs may be inaccurate, incomplete, outdated, or unsuitable for your circumstances.
6) Acceptable Use
You agree not to:
- Use the Service for unlawful, harmful, or abusive purposes.
- Access or attempt to access the Service or systems without authorization.
- Interfere with or disrupt the Service, including by bypassing security or overloading systems.
- Reverse engineer or attempt to extract source code, except where prohibited by law.
- Use automated tools (bots/scrapers) in a way that harms the Service or violates law.
7) Privacy & Intellectual Property
Privacy
Your use of the Service is also governed by our Privacy Policy (provided separately). It describes what information we collect and how we use and share it.
Intellectual property
The Service (excluding your content) is owned by Flixi or its licensors and is protected by intellectual property laws. We grant you a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes.
8) Third-Party Services & Apple iOS Notice
The Service may interact with third-party services (e.g., operating systems or app distribution platforms). We are not responsible for third-party services, and your use of them may be governed by their terms and policies.
Apple iOS notice (if you use iOS)
- Apple is not a party to these Terms and is not responsible for the Service.
- Apple is a third-party beneficiary of these Terms to the extent relating to your use of the iOS app and may enforce these Terms against you as a third-party beneficiary.
9) Termination, Disclaimers, and Liability
Termination
You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe you violated these Terms, posed a security risk, or if required by law.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLIXI DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLIXI WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLIXI’S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID TO FLIXI FOR THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT (OR, IF YOU PAID NOTHING, USD $10).
10) Indemnification & Changes
Indemnification
To the maximum extent permitted by law, you agree to indemnify and hold harmless Flixi from claims and expenses arising from your content, your use of the Service, or your violation of these Terms.
Changes to these Terms
We may update these Terms from time to time and will update the Effective Date when changes are made. If changes are material, we will provide notice through the Service or other appropriate means. Continued use after changes become effective means you accept the updated Terms.
11) Governing Law & Binding Arbitration
These Terms are governed by the laws of the jurisdiction of our principal place of business, without regard to conflict of laws principles.
Except where prohibited by law, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis. The arbitrator’s decision will be final and binding.
You and Flixi waive the right to a trial by judge or jury and waive participation in class actions or class-wide arbitration.
This section does not limit either party’s right to seek injunctive or equitable relief for unauthorized use of intellectual property or where arbitration is not permitted.
12) Miscellaneous
- Severability: If any provision is invalid, the remaining provisions remain in effect.
- Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms as part of a merger, acquisition, or sale of assets.
- Entire agreement: These Terms and any additional terms you accept within the Service form the entire agreement regarding the Service.
